Terms and conditions

1. Introduction
At Smart Homes Real Estate, we are committed to transparency, mutual trust, and providing a seamless service experience. To ensure clarity and avoid misunderstandings, clients are required to review and complete specific forms that outline the terms and conditions governing our services. By completing these forms, the client acknowledges their understanding and agreement to these terms.

2. Engagement and Contractual Agreement
Before any property search or listing, clients must complete and sign the required paperwork. Without a signed document, Smart Homes Real Estate is not obligated to provide services, and no binding contract or agreement exists.

3. Obligations of Smart Homes Real Estate
Smart Homes Real Estate commits to delivering our services with diligence, professionalism, and expertise, including:

  • Conducting property searches that align with the client’s preferences.
  • Providing professional advice based on market trends, property values, and legal regulations.
  • Maintaining open communication and transparency throughout the buying or selling process.

4. Obligations of the Client
Clients agree to the following:

  • If a client chooses to buy or rent any property introduced by Smart Homes Real Estate, a commission is owed to us upon the client’s financial commitment to the property.
  • Withholding commission due to Smart Homes Real Estate will incur interest at the current Bank of Ghana rate for each day the commission remains unpaid.
  • Clients are responsible for official search reports from relevant government agencies, especially when buying land or buildings.
  • Knowing the owner(s) of a property through personal connections (e.g., relative, friend, spouse) does not change the commission agreement if the property is acquired through Smart Homes Real Estate.
  • Contacting numbers on property signage (other than Smart Homes Real Estate’s) does not alter the commission agreement should the client rent or purchase the property.
  • Smart Homes Real Estate is not responsible for transporting clients to view properties.
  • Choosing Smart Homes Real Estate services is entirely voluntary and remains at the client’s discretion at all times.

5. Commission and Fees
As compensation for our services, the client agrees to pay Smart Homes Real Estate a commission of [x%] of the total sale or rental price at the time of closing. The commission rate may vary based on market conditions and is outlined in the initial documentation. If the final sale or rental price differs from the listed price, the commission will be adjusted proportionally. Commissions are due at closing unless otherwise specified in a written agreement.

6. Payment Terms
All payments should be completed via accepted methods, such as bank transfers, credit or debit cards, or mobile money services. Any delay in payment beyond the agreed date may incur interest charges in accordance with local regulations.
